California's New Pay Transparency Law: What You Need to Know

That's why we want to highlight California's new pay transparency law that went into effect on January 1st, 2023. This legislation, known as Senate Bill 1162, requires employers to include a salary range in any job posting for a position located in California. This means that links to the pay scale or QR codes are not permitted as a substitute for placing the wage information in the actual posting.
This new law is part of California's continued effort to address pay inequity in the workplace. By increasing transparency around pay scales, job applicants have access to information about the salary range for a particular position before applying. This information can help applicants make more informed decisions about whether to apply for a job and can also help them negotiate a fair salary if they are offered the position.
Employers with 15 or more employees must comply with the new law or face penalties of up to $10,000 per violation. Additionally, the law provides for a private right of action, meaning that employees or job applicants who believe that an employer has violated the law can sue for damages.
For larger employers, complying with the new law involves reviewing their job posting procedures and ensuring that all job postings for positions located in California include a salary range. Employers must also be prepared to answer questions about the salary range for a particular position and be prepared to negotiate salary offers within the range provided.
